Situations that could lead to a slip-and-fall accident

Louisiana residents likely enter various businesses on a weekly basis. Whether it is a grocery store, department store, restaurant or an office building, patrons entering these establishments expect that these businesses are safe to enter. However, when business owners fail to ensure the interior and surrounding area of a public business are safe, this could place legal liability on the owner.

A slip-and-fall accident is a common incident that could cause injury to a visitor of a public business. This post will focus on the common situation that could lead to a slip-and-fall accident, who could be liable and what damages might be available.

The conditions of the floor within a business are a major source for a slip-and-fall accident. For example, wet floors, using too much wax or polish, failing to provide adequate warnings, failing to use floor treatment with non-skid ingredients or failing to clean up spills. Additionally, failing to fix torn, worn, broken or bulging carpet could also be the source of a fall.

Stairs could also be the source of a slip-and-fall accident. If they are worn or rounded, covered with debris, dirt, gum or trash, lack non-skid surface or have a missing or broken guardrail, this could generate a fall to an unsuspecting patron.

Lastly, escalators and elevators could also be the cause of a slip-and-fall accident within a business. This could occur when there are sudden glitches with the machinery, when clothing, footwear, fingers, hands or feet get caught in the parts of an escalator or elevator or when either of these mechanisms fail to operate safely.

When a slip-and-fall accident occurs, there is recourse available to an injured party. A negligent property owner could be held liable and a premises liability claim could help an individual collect compensation for any serious injuries suffered.
