Is your slip-and-fall accident really your fault?

If you fell while in a Louisiana store, business, private residence, on a public sidewalk or other place, you were probably embarrassed and ready to just get up and move on as quickly as possible. It is easy in the moments after an accident to assume that it was your fault, perhaps caused by inattentiveness or clumsiness, but in reality, you may not be to blame. A slip-and-fall accident can be painful and traumatic, but you do not have to face the aftermath alone.

What is so bad about a fall?

If you fell, you may believe that the only thing injured was your pride. In many cases, fall victims experience a range of injuries that can be painful, lingering and compromising to quality of life. Some of the most common injuries suffered by slip-and-fall accident victims include:

  • Brain injuries
  • Spinal cord injuries
  • Fractures
  • Injuries to wrists and knees
  • Shoulder injuries
  • Injuries to the neck and back

When a fall is particularly serious, victims may never fully recover from their injuries. Others may require surgery, therapy, rehabilitation and other expensive medical treatments. Even a minor fall can cause significant damage, and some victims may not fully understand the scope of their injuries until days or weeks later.

Find out who is at fault

Property owners or other parties may be liable for your pain and suffering if you experienced a fall on public or privately owned property. Properly identifying liable parties can be a complex process, but you may have a valid case if any of the following played a role in your slip-and-fall accident:

  • Wet floors
  • Uneven sidewalks
  • Poor lighting
  • Ice or snow on walkways
  • Dangerous stairs
  • Holes or cracks in the pavement
  • Slippery floors

When facing a premises liability claim, a property owner will likely work hard to minimize liability and place some or all of the blame on you. The insurance company may be reluctant to pay a fair settlement, even when presented with evidence and documentation of injuries and damage.

The rights of slip-and-fall victims

People who suffer due to the negligent or reckless actions of another person have the right to seek a full recovery, including those injured in slip-and-fall accidents. Even if you are unsure of what factors played a role in your accident, it is always worthwhile to seek a full explanation of your options and understand how you may be able to secure deserved restitution.
