Fatal collision takes life of mayor

Loreauville must now begin the search for a new mayor. The village has lost its mayor after a deadly car crash took his life over the weekend. According to local newspaper articles, the mayor, Albert Broussard, was pronounced dead at the scene by medical examiners.

The car accident occurred when the vehicle in which Broussard was a passenger was hit by a truck that crashed into it head-on. Passengers in the truck were also injured and required medical attention. The driver of the car that Broussard rode in remains hospitalized at this time. The accident is still under investigation, andthe cause has not yet been released by officials.

If a law suit is filed as a result of this accident, there may be an issue of negligence to be determined. Negligence is the legal theory that involves duty, breech, causation and damages. Every driver on the road owes a reasonable duty of care to every other driver. When a driver violates this duty, he or she may cause injury to another. The damages that are suffered by the victim of the accident may be recovered in a negligence claim.

The state of Louisiana is a comparative negligence state. This means that a plaintiff’s overall reward is decreased by the percentage of their own negligence. For example, if $100,000 was awarded by a jury and a plaintiff was assessed to be 40% at fault for his or her injuries, the net reward for the plaintiff would be $60,000.
